1. Acceptance of Terms

By accessing or using the 60 Second Message website, mobile application, web recorder, or any related services (collectively, "the Service"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to these Terms, you must not access or use the Service.

These Terms constitute a legally binding agreement between you and 60 Second Message ("we", "us", or "our"). If you are using the Service on behalf of an organisation, you represent and warrant that you have the authority to bind that organisation to these Terms.

We may update these Terms from time to time, and the "Last updated" date above will reflect the most recent revision. Your continued use of the Service after any changes constitutes acceptance of the updated Terms.

2. Description of Service

60 Second Message is a platform that enables users to create collaborative video tributes for personal occasions. The Service works as follows:

  • Organisers create events (such as birthdays, farewells, memorials, retirements, weddings, and other occasions), select a video quality tier, and invite contributors.
  • Contributors receive invitations via email containing a unique link. They record a video message of up to 60 seconds directly in their browser — no account creation or app installation is required.
  • Compilation — The organiser arranges submitted video clips, photos, and text cards, selects frame templates, transitions, and background music, then creates a compiled tribute video.
  • Sharing — The compiled video is hosted and made available via a unique shareable link for a limited period. Anyone with the share link can view the compiled video. The organiser is responsible for sharing the link only with intended recipients.

3. Eligibility & Account Responsibilities

You must be at least 16 years of age to use the Service. By using the Service, you represent and warrant that you meet this age requirement.

If you create an account, you agree to:

  • Provide accurate, current, and complete information during registration.
  • Maintain and promptly update your account information to keep it accurate.
  • Maintain the security and confidentiality of your login credentials.
  • Accept responsibility for all activities that occur under your account.
  • Notify us immediately of any unauthorised use of your account.

Contributors who record videos via an invitation link are not required to create an account but are still bound by these Terms when using the Service.

4. Prohibited Content & Conduct

You agree not to use the Service to upload, record, share, or distribute any content that:

  • Is pornographic, sexually explicit, or depicts nudity — The recording and sharing of pornographic or sexually explicit material of any kind is strictly prohibited. This includes but is not limited to sexually suggestive content, nudity, and any material that would be considered obscene or indecent.
  • Is illegal, or promotes or facilitates illegal activity.
  • Contains hate speech, discrimination, or content that targets individuals or groups based on race, ethnicity, religion, gender, sexual orientation, disability, or any other protected characteristic.
  • Harasses, bullies, intimidates, threatens, or incites violence against any person or group.
  • Is defamatory, libellous, or fraudulent.
  • Infringes on the intellectual property rights, privacy rights, or any other rights of a third party.
  • Contains malware, viruses, or any harmful code.
  • Impersonates another person or misrepresents your identity or affiliation.
  • Depicts or promotes self-harm, suicide, or dangerous activities.
  • Contains content that exploits or endangers minors in any way.
  • Is spam, unsolicited advertising, or commercial solicitation.

You further agree not to:

  • Use the Service for any purpose other than creating personal video tributes.
  • Attempt to gain unauthorised access to any part of the Service, other users' accounts, or our systems.
  • Use automated tools, bots, or scripts to access or interact with the Service.
  • Interfere with or disrupt the integrity or performance of the Service.
  • Reverse-engineer, decompile, or disassemble any part of the Service.
  • Use the Service to send unsolicited invitations or messages to people who have not consented to receive them.

5. Content Moderation & Enforcement

We reserve the right, but are not obligated, to review, monitor, or remove any content uploaded to the Service at our sole discretion. If we become aware of content that violates these Terms, we may:

  • Remove or disable access to the offending content without notice.
  • Suspend or terminate the account of the user who uploaded the content.
  • Report the content or user to relevant law enforcement authorities where required or appropriate.
  • Cancel the associated event and forfeit any payments made.

6. Content Ownership & Licence

Your content. You retain full ownership of all videos, photos, and other content you upload to the Service. We do not claim ownership of your content.

Licence grant. By uploading content, you grant 60 Second Message a limited, non-exclusive, royalty-free, worldwide licence to use, process, store, transcode, and deliver your content solely for the purpose of providing the Service. This includes normalising video formats, applying frame overlays and transitions, mixing audio, and compiling tribute videos. This licence terminates when your content is deleted from our systems.

Organiser responsibility. If you are an event organiser, you are responsible for ensuring that you have the consent of contributors before including their content in a compiled video. You are also responsible for the use and distribution of the compiled video.

Contributor consent. By recording and submitting a video contribution, you consent to your content being included in the compiled tribute video and shared by the event organiser. Contributors may request deletion of their video at any time by contacting the event organiser or by emailing us directly.

7. Intellectual Property

The Service, including its design, logos, text, graphics, software, frame templates, music library, and all other materials (excluding user-generated content), is owned by or licensed to 60 Second Message and is protected by copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of the Service or its content, nor may you reverse-engineer or attempt to extract the source code, unless expressly permitted by law.

Music library. Background music tracks provided through the Service are licensed for use within compiled tribute videos only. You may not extract, download, or use these tracks separately or for any other purpose.

Copyright complaints. If you believe that content on the Service infringes your copyright, please contact us at support@sixtysecondmessage.com with a description of the copyrighted work, identification of the infringing content, and your contact information. We will investigate and take appropriate action, which may include removal of the content.

8. Data Retention & Deletion

We apply the following data retention policies:

  • Raw video uploads are automatically deleted 21 days after upload or after the event's submission deadline, whichever comes first.
  • Compiled videos are hosted for thirty (30) days after creation, after which they are automatically deleted from our servers. This hosting period may be extended through paid monthly extensions.
  • Account data (name, email, profile information) is retained for as long as your account is active. You may request deletion of your account and all associated data at any time.
  • Event metadata is deleted when the event's compiled video is deleted, or upon account deletion.

We strongly recommend that you download your compiled video before the hosting period expires. Once a video has been deleted, it cannot be recovered.

9. Payments, Pricing & Refunds

Pricing. Event creation is charged on a pay-per-event basis. There are no subscriptions or recurring charges for event creation. Prices vary based on the selected video quality tier and number of contributors. All prices are displayed in Australian Dollars (AUD) and are inclusive of GST where applicable.

Payment processing. All payments are processed securely through Stripe. By making a purchase, you agree to Stripe's terms of service. We do not store your full payment card details — these are handled entirely by Stripe in accordance with PCI-DSS standards.

Hosting extensions. After the initial 30-day hosting period, you may purchase monthly extensions to keep your compiled video available online. Extension charges are billed monthly and may be cancelled at any time.

Refunds. Due to the nature of the Service (digital content creation and delivery), refunds are generally not provided once video compilation has begun. However, we may offer a refund at our discretion if:

  • The Service experienced a significant technical failure that prevented delivery of the compiled video.
  • You request a refund before any contributors have submitted recordings and before compilation has begun.

To request a refund, contact support@sixtysecondmessage.com within fourteen (14) days of purchase.

10. Service Availability & Limitations

We strive to maintain the availability and reliability of the Service but do not guarantee uninterrupted or error-free operation. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

We reserve the right to:

  • Modify, suspend, or discontinue any part of the Service at any time with reasonable notice.
  • Impose limits on certain features or restrict access to parts of the Service.
  • Update pricing for future events (existing purchases are not affected).

Video processing. Compilation times may vary depending on the number and length of video clips, the selected quality tier, and current system load. We do not guarantee specific processing times.

11. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, or statutory. To the maximum extent permitted by law, we disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

  • The Service will meet your specific requirements.
  • The Service will be uninterrupted, timely, secure, or error-free.
  • The quality of any compiled video will meet your expectations.
  • Any errors in the Service will be corrected.

12. Limitation of Liability

To the maximum extent permitted by applicable law, 60 Second Message and its directors, employees, partners, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or loss of goodwill, arising out of or in connection with your use of the Service.

Our total aggregate liability for any claims arising out of or relating to the Service shall not exceed the amount you have paid to us in the twelve (12) months preceding the claim.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including guarantees under the Australian Consumer Law (Competition and Consumer Act 2010 (Cth)) and liability for fraud or personal injury caused by negligence.

13. Indemnification

You agree to indemnify, defend, and hold harmless 60 Second Message and its directors, employees, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:

  • Your use of the Service or any content you upload.
  • Your violation of these Terms.
  • Your violation of any rights of a third party, including intellectual property or privacy rights.
  • Any content you upload that is found to be prohibited under Section 4 of these Terms.

14. Termination

You may stop using the Service and delete your account at any time by contacting us or using the account deletion feature within the app.

We may suspend or terminate your access to the Service immediately, without prior notice or liability, if:

  • You breach any provision of these Terms.
  • You upload content that violates Section 4 (Prohibited Content & Conduct).
  • We are required to do so by law.
  • We reasonably believe your account has been compromised.

Upon termination, your right to use the Service will immediately cease. We may delete your content and account data in accordance with our data retention policies. Sections of these Terms that by their nature should survive termination will remain in effect, including Sections 6, 7, 11, 12, 13, and 15.

15. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of Australia. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Australia.

Before initiating any formal legal proceedings, you agree to first attempt to resolve any dispute informally by contacting us at support@sixtysecondmessage.com. We will make reasonable efforts to resolve the matter within thirty (30) days.

If the dispute cannot be resolved informally within 30 days, either party may refer the dispute to mediation administered by the Australian Disputes Centre (ADC) in accordance with their mediation rules. If the dispute is not resolved through mediation within 60 days, either party may commence court proceedings.

Nothing in this section prevents either party from seeking urgent injunctive or interlocutory relief from a court of competent jurisdiction.

16. General Provisions

  • Entire agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and 60 Second Message regarding your use of the Service.
  • Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
  • Waiver. Our failure to enforce any right or provision of these Terms shall not be considered a waiver of that right or provision.
  • Assignment. You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
  • No third-party beneficiaries. These Terms do not confer any rights on any third party.
